3. Account Registration and Eligibility

3.1 Eligibility Requirements

To use our Service, you must:

4.2 Billing and Payment

  • Subscription fees are billed monthly or annually in advance
  • All fees are non-refundable except as required by law
  • Automatic renewal unless cancelled before the renewal date
  • Price changes require 30 days' advance notice
  • Late payments may result in service suspension

4.3 Free Trial

We offer a 14-day free trial for new customers. No credit card is required for the trial period. Trial limitations may apply, and the trial automatically expires without conversion to a paid plan.

5. Acceptable Use Policy

5.1 Permitted Uses

You may use our Service for legitimate business purposes, including:

5.2 Prohibited Activities

7.2 Customer Content

You grant us a limited license to use, process, and display your content solely to provide the Service. You represent that you have all necessary rights to grant this license.

7.3 Feedback and Suggestions

Any feedback, suggestions, or ideas you provide about the Service become our property and may be used without compensation or attribution.

8. Service Level Agreement (SLA)

8.1 Uptime Commitment

We commit to the following uptime levels:

  • Professional Plan: 99.5% monthly uptime
  • Enterprise Plan: 99.9% monthly uptime
  • Planned maintenance windows excluded from calculations
  • Service credits available for SLA breaches

8.2 Support Response Times

  • Starter Plan: 48-hour email response
  • Professional Plan: 24-hour priority support
  • Enterprise Plan: 4-hour response with dedicated support manager

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUXBRAIN AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE.

Our total liability for any claims arising from or related to the Service shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless LuxBrain AI from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

11.1 Termination by You

You may terminate your account at any time by cancelling your subscription through the platform or contacting our support team. Termination is effective at the end of your current billing period.

11.2 Termination by Us

We may terminate your account immediately if you:

  • Violate these Terms or our Acceptable Use Policy
  • Fail to pay fees when due (after 30-day grace period)
  • Engage in fraudulent or illegal activities
  • Pose a security risk to our systems or other users

11.3 Effect of Termination

Upon termination, your access to the Service will cease immediately. We will retain your data for 30 days to allow for account reactivation, after which it will be permanently deleted unless legally required to retain it.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of Pakistan, without regard to conflict of law principles.

12.2 Dispute Resolution Process

For any disputes arising from these Terms:

  • First, contact our support team to resolve the issue informally
  • If unresolved, disputes will be subject to binding arbitration
  • Arbitration will be conducted in Lahore, Pakistan
  • Class action lawsuits are waived

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through:

  • Email notifications to all registered users
  • Prominent notices in the platform interface
  • Updates to this page with revision dates
  • At least 30 days' advance notice for material changes

Continued use of the Service after changes become effective constitutes acceptance of the new Terms.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional agreements, constitute the entire agreement between you and LuxBrain AI.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

15.3 Assignment

You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

15.4 Force Majeure

Neither party will be liable for delays or failures in performance due to circumstances beyond their reasonable control, including natural disasters, government actions, or network outages.
